EL PASO, Texas – Jesse Garay, 26, of El Paso is facing serious federal charges after allegedly running a clandestine firearm trafficking operation, according to a Department of Justice announcement. Garay was arrested in El Paso and stands accused of illegally acquiring and selling guns, including potentially to a minor, and then lying on federal paperwork to cover his tracks.

Court documents detail a pattern of purchases made by Garay between September 7, 2022, and March 24, 2023. Each time, he certified on the required Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Form 4473 that he was the true buyer of the firearms. However, investigators say private messages recovered through a search warrant tell a different story – a story of resale, profiting from illegal gun sales, and a blatant disregard for the law.

The scope of Garay’s alleged operation is chilling. At least three of the firearms he purchased have surfaced in connection with criminal activity, either at crime scenes within the United States or across the border in Mexico. This raises serious concerns about the potential for these weapons to fuel violence on both sides of the border, and investigators are actively tracing the full extent of the distribution network.

Garay is now charged with one count of trafficking in firearms, a felony that carries a potential sentence of up to 15 years in federal prison. He also faces a charge of dealing firearms without a license, punishable by up to five years behind bars. Adding to the severity of the accusations are two counts of false statement during a firearm acquisition, each carrying a maximum sentence of 10 years. U.S. Attorney Jaime Esparza for the Western District of Texas and Special Agent in Charge Jeffrey C. Boshek II of the ATF Dallas Field Division jointly announced the arrest. The ATF is leading the investigation, with Assistant U.S. Attorney Mathew Engelbaum handling the prosecution. This case highlights the ATF’s continued commitment to disrupting illegal gun trafficking and holding those responsible accountable.
