EL PASO, Texas – It’s a gritty tale of gunrunning in the Borderlands as El Paso man Jesse Garay, 26, finds himself staring down the barrel of federal charges after being nabbed by the ATF for alleged firearm trafficking and selling without a license.

According to court documents, Garay is accused of purchasing numerous firearms between Sept. 7, 2022, and March 24, 2023, falsely claiming he was the buyer on ATF Form 4473. But this wasn’t just a hobby for the young gunrunner; private messages obtained in a search warrant suggest Garay sold his illegal wares to other individuals, including a minor.

The ATF’s investigation turned up more grim details: at least three firearms purchased by Garay were recovered from crime scenes or in Mexico. This isn’t just a street-level hustle; it’s a direct threat to public safety, and the law is responding with serious charges.

Garay faces one count of trafficking in firearms, one count of dealing firearms without a license, and two counts of false statement during a firearm acquisition. If convicted, the 26-year-old could be looking at up to 15 years for the trafficking charge alone, plus five years for dealing without a license and ten years for each false statement count.

U.S. Attorney Jaime Esparza of the Western District of Texas and Special Agent in Charge Jeffrey C. Boshek II for the ATF Dallas Field Division were quick to announce the charges, signaling a zero-tolerance stance on gun trafficking in the region.

The ATF is leading the investigation into Garay’s alleged crimes, while Assistant U.S. Attorney Mathew Engelbaum is tasked with prosecuting the case. Remember, an indictment is merely an allegation and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
