A Rapid City man has been accused of breaking free from a halfway house and failing to return. Elias LaPointe, 23, was indicted on May 24, 2016 for Escape from Custody in the Community Education Center in Rapid City, South Dakota.
According to the U.S. Attorney Randolph J. Seiler, LaPointe appeared before U.S. Magistrate Judge Daneta Wollmann on June 3, 2016 and pleaded not guilty to the indictment.
The charge of Escape from Custody carries a maximum penalty of 5 years of imprisonment, a $250,000 fine, 3 years of supervised release, and a payment of $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
LaPointe’s case is being conducted by the U.S. Marshals Service. Assistant U.S. Attorney Sarah B. Collins is responsible for prosecuting the case against him.
LaPointe was detained pending trial, with a trial date set for July 26, 2016.
It’s essential to note that the charge against LaPointe is merely an accusation, and he is presumed innocent until proven guilty in a court of law.
