The grimy underbelly of the food industry has been exposed in Staten Island, New York, where a federal court has entered a permanent injunction against Euroline Foods, LLC, Royal Seafood Baza, Inc., and their owner/operators for violating food safety requirements.
According to a complaint filed by the U.S. Food and Drug Administration (FDA) in May 2018, the defendants’ food preparation facility at 175 Lake Avenue, Staten Island, New York, was plagued by chronic insanitary conditions, including the presence of Listeria monocytogenes (L. mono).
The complaint alleged that the defendants failed to implement effective sanitation controls to comply with current Good Manufacturing Practice (CGMP) requirements and seafood Hazard Analysis and Critical Control Point (HACCP) regulations. As a result, the defendants were processing and distributing ready-to-eat fish and fishery products, vegetable salads, and cheese products in a facility that posed a significant risk to public health.
Under the terms of the consent decree, the defendants have agreed to settle the litigation and be bound by a permanent injunction. The defendants have ceased their at-risk processing operations and destroyed affected food preparation equipment. They are also required to notify the FDA in writing at least 90 days in advance of resuming food processing and preparation operations and to comply with specific remedial measures set forth in the injunction.
The defendants, Euroline Foods, LLC, Royal Seafood Baza, Inc., Eduard Shnayder, Syoma Shnayder, Albert Niyazov, and Oleg Polischouk, have been permanently barred from processing any foods, other than prepackaged foods that will remain in their original containers, at their Staten Island facility, and any foods that might present a Listeria monocytogenes hazard at any other facility until they establish that they can comply with all applicable laws and regulations.
The U.S. Attorney’s Office for the Eastern District of New York and the FDA will continue to work together to ensure that food processors adhere to laws enacted to protect consumers. The public is advised to always check the labels of food products and to report any concerns about food safety to the FDA.
