Daly City Resident Pleads Guilty to Tax Fraud Scheme

Oakland, CA – In a shocking turn of events, Everardo Laurian, a 26-year-old resident of Daly City, California, has pleaded guilty to his involvement in a tax fraud scheme. According to the plea agreement, Laurian participated in a conspiracy to illegally obtain money from the United States between March and April 2015.

The scheme, which involved filing false federal income tax returns to obtain fraudulent federal income tax refunds and cashing stolen U.S. Treasury checks at Walmart stores throughout the United States, netted Laurian and his co-conspirators a total of $88,826.41 in stolen funds.

Laurian’s role in the scheme was to drive individuals to Walmart stores and cash the stolen or fraudulently obtained U.S. Treasury checks, and then deliver the proceeds to his co-conspirators. The conspiracy involved multiple individuals, including Gary Bostick, 39, and Ana Bostick, 37, both of Pittsburg, California.

On November 5, 2015, a federal grand jury indicted Laurian and ten co-conspirators for various crimes in connection with the scheme. Laurian was charged with conspiracy to defraud the United States, theft of public money, and aggravated identity theft.

Laurian pleaded guilty to two counts of theft of public money. The maximum sentence for theft of public money is ten years in prison and a fine of $250,000. Judge Jeffery S. White accepted Laurian’s plea and scheduled his sentencing for September 26, 2017.

The prosecution of Laurian and his co-conspirators is the result of an investigation by the Internal Revenue Service, Criminal Investigation. Assistant U.S. Attorneys Thomas Newman and Jose A. Olivera, along with Trial Attorney Gregory Bernstein and Paralegal Jonathan Deville of the Tax Division, are prosecuting the case.
