Montgomery, Alabama – In a shocking turn of events, former Fort Rucker soldier Benjamin Schrad was sentenced to six years in prison for manslaughter on January 9, 2015. The sentence was announced by United States Attorney for the Middle District of Alabama, George L. Beck, Jr., who noted that it exceeded the recommended range of 33-41 months as outlined in the Federal Sentencing Guidelines.
Schrad, aged 31 from Storm Lake, Iowa, rushed his four-year-old daughter to an emergency room in Enterprise in August 2011, claiming she collapsed while at home. However, medical testimony during the trial proved that the girl was violently shaken, and her injuries were inconsistent with a simple fall.
U.S. Attorney George Beck expressed gratitude for the judge’s decision to upwardly depart from the sentencing guidelines, noting, “This is a heartbreaking case involving the death of a child. A review of the current guidelines by the Sentencing Commission would be welcomed, followed by revisions that ensure punishment adequately reflects the devastating nature of the crime.”
This investigation was conducted by the Federal Bureau of Investigation (FBI), the Army Criminal Investigative Division at Fort Rucker, and the Alabama Department of Forensic Sciences. The Birmingham Children’s Hospital also played a crucial role in the case.
