PENSACOLA, FL – Maria Victoria Borja-Avila, 47, of Mexico, is facing federal prison time after admitting to a brazen scheme to illegally enter the United States using a stolen identity and fabricated documents. Borja-Avila pleaded guilty today in Pensacola to charges of Passport Fraud, Falsely Representing U.S. citizenship, and Aggravated Identity Theft, offenses that carry significant penalties.

U.S. Attorney John P. Heekin didn’t mince words about the case. “This defendant tried to lie, cheat, and steal her way into this country, but thanks to the diligent investigatory work of our federal partners she’ll spend time in a prison cell before being removed,” Heekin stated. “My office will continue to aggressively pursue violations of our nation’s immigration laws.” The statement underscores the federal government’s hardline stance on immigration fraud.

According to court documents, Borja-Avila presented forged information in a U.S. Passport Application at the Santa Rosa County Clerk’s Office on August 14, 2023. She falsely claimed to be a U.S. citizen, backing up her lie with a stolen birth certificate and a fraudulent Florida driver’s license. The scheme involved the complete usurpation of another person’s identity, a serious federal offense. Investigators from the U.S. Department of State’s Diplomatic Security Service untangled the deception, bringing Borja-Avila to justice.

The penalties facing Borja-Avila are substantial. She’s staring down a mandatory two-year sentence for Aggravated Identity Theft, to run concurrently with any other sentence imposed. Additionally, she could receive up to ten years in prison for the Passport Fraud charge. But her legal troubles don’t end with incarceration. An ICE detainer has already been lodged, meaning deportation proceedings will begin immediately after she completes her prison term. Even after deportation, Borja-Avila faces up to three years of supervised release – any return to the U.S. during that period could trigger additional prison time.

This case is part of “Operation Take Back America,” a nationwide initiative aimed at bolstering border security, dismantling cartels, and combating violent crime. The operation streamlines resources from the Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhoods, demonstrating a unified federal approach to tackling illegal immigration and transnational criminal activity. The Northern District of Florida is one of 94 U.S. Attorney’s Offices participating in the initiative.

Assistant United States Attorney Jennifer H. Callahan is prosecuting the case. Sentencing is scheduled for October 16, 2025, at 1:00 pm at the United States Courthouse in Pensacola before United States District T. Kent Wetherell.
