LOS ANGELES – A financial TV analyst and CEO, James Arthur McDonald Jr., 53, was sentenced today to five years in federal prison for orchestrating a multimillion-dollar Ponzi scheme that bilked investors out of over $3 million. The former San Gabriel Valley resident, who once graced CNBC’s airwaves as an analyst, pleaded guilty on April 7 to securities fraud charges.
McDonald, the CEO and chief investment officer at Hercules Investments LLC and Index Strategy Advisors Inc., (ISA), exploited his credibility as a financial expert to defraud clients of both companies. He lost tens of millions in client money through risky investments in late 2020 and then misappropriated funds raised for a capital raise, using them to fund luxury purchases and maintain his high lifestyle.
In early 2021, McDonald solicited $675,000 from investors under false pretenses, much of which he spent on a Porsche. He also defrauded ISA clients by commingling their funds with his personal bank account for his own expenses and Ponzi-like payments to some of those same clients.
McDonald became a fugitive after failing to appear before the SEC in 2021, evading capture until his arrest in Washington state in June 2024. Authorities found a fake driver’s license with his photo at his hideout. Prosecutors argued that McDonald betrayed the trust of his victims by misleading them about the American Dream.
The FBI and IRS Criminal Investigation division investigated this case, leading to the SEC filing a civil complaint against McDonald and Hercules in September 2022. In April 2024, Judge Percy Anderson found them liable and ordered millions in disgorgement and penalties.
Assistant United States Attorneys Alexander B. Schwab and Nisha Chandran prosecuted this case, ensuring justice for the investors McDonald deceived. McDonald will now face his own consequences for his fraudulent actions.
