TAMPA, FL – Eddy Fonseca, 25, of Tampa, is trading his freedom for a federal prison cell after being sentenced to 5 years and 11 months for illegally possessing firearms and ammunition. U.S. District Judge Steven D. Merryday delivered the sentence following Fonseca’s guilty plea on January 30, 2024. The conviction slams shut another door on a repeat offender who clearly disregarded the law.
Fonseca’s criminal history disqualifies him from owning firearms. He was previously convicted of aggravated assault with a deadly weapon in 2019. Yet, in May 2023, Fonseca brazenly attempted to circumvent the law, using his girlfriend as a proxy to purchase a firearm. Law enforcement caught onto the scheme when they observed the pair at a local firearms store. While Fonseca’s girlfriend filled out the paperwork, it was Fonseca’s cash that funded the purchase.
The feds didn’t stop there. Officers followed Fonseca back to his Tampa residence and watched as he carried the box containing the newly purchased firearm inside. A subsequent search warrant revealed the single firearm was just the tip of the iceberg. Authorities discovered a total of six firearms stashed throughout the home, all claimed by Fonseca in his plea agreement. He thought he could hide them; he was wrong.
The investigation was a joint effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Hillsborough County Sheriff’s Office. Assistant United States Attorney Samantha Newman prosecuted the case, with forfeiture handled by Assistant United States Attorney James Muench. These agencies are working tirelessly to keep weapons out of the hands of those who would misuse them, and Fonseca is a prime example of why.
This case isn’t an isolated incident. It falls under Project Safe Neighborhoods (PSN), a broad initiative designed to reduce violent crime and gun violence nationwide. Launched in 2021, the program focuses on fostering trust within communities, supporting local violence prevention efforts, and prioritizing strategic enforcement. The Department of Justice is doubling down on these efforts, and Fonseca’s sentence sends a clear message.
Fonseca’s attempt to arm himself despite his criminal record will now cost him nearly six years of his life. This isn’t just about guns; it’s about accountability.
