Former Clerk Charged in Bond Scheme Scandal

LEAR ENCLARDE, a 68-year-old New Orleans resident, has been charged with conspiracy to commit honest services mail fraud in a shocking case of corruption within the Orleans Parish Criminal Clerk’s Office.

According to court documents, ENCLARDE, who worked in the Orleans Parish Criminal Clerk’s Office from 1973 through 2010, accepted cash and things of value from an unlicensed bail bondsman in exchange for permitting the unlicensed bondsman to use the name of another, licensed bondsman and to forge that licensed bondsman’s signature on official court documents.

The scheme, which allegedly took place over several years, has left many wondering how such a blatant disregard for the law went unchecked. ENCLARDE’s actions not only compromised the integrity of the court system but also put innocent lives at risk.

ENCLARDE faces a maximum term of imprisonment of five years, a fine of $250,000 and three years of supervised release following any term of imprisonment if convicted.

US Attorney Dana J. Boente reiterated that the Bill of Information is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The case was investigated by the Federal Bureau of Investigation, the New Orleans Police Department, the Orleans Parish District Attorney’s Office, and the United States Attorney’s Office. Assistant US Attorney Dan Friel will be prosecuting the case.

The people of Louisiana demand justice, and we will continue to expose the corrupt practices that have plagued our state for far too long. This case serves as a reminder that no one is above the law, and those who break it will be held accountable.
