NEW YORK – While parents scrambled to feed their babies during the 2022 national formula shortage, two companies were allegedly lining their pockets. New York Attorney General Letitia James today announced the delivery of over $344,000 worth of baby formula to families in the Bronx, seized as part of a settlement with Marine Park Distribution Inc. (Marine Park) and its affiliate, Formula Depot Inc. (Formula Depot), for illegal price gouging. The Grimy Times has learned this is just a portion of a larger $675,000 recovery.
The Attorney General’s Office (OAG) investigation revealed Marine Park and Formula Depot weren’t just marking up prices – they were exploiting a crisis. At times, a can of formula that previously sold for $18 was being peddled for a shocking $36. This wasn’t a simple price increase; it was a calculated move to capitalize on the desperation of parents struggling to find nourishment for their children. One consumer, relying on Formula Depot for specialized formula for a child with allergies, saw a case of formula jump from $190 to $245 in mere weeks.
“Using a national emergency to raise prices on hardworking families who are struggling to find enough food for their children is despicable,” Attorney General James stated. “Marine Park broke the law when they took advantage of a dangerous formula shortage to make even higher profits, and now they have to pay for it. Thanks to my office’s investigation, today we’re delivering essential baby formula to families in the Bronx.” The formula will be distributed through Roads to Success, a Bronx-based nonprofit.
Sheila Duke, CEO of Roads to Success, emphasized the critical need. “Access to baby formula is not just a necessity, it is a lifeline for parents striving to provide for their children,” she said. “This generous donation will bring much-needed relief to Bronx families.” Duke’s organization has been battling a surge in food insecurity, making this delivery a significant win for the community.
New York’s price gouging laws are clear: vendors can’t exploit emergencies to inflate prices on vital goods. Attorney General James had already issued warnings to over 30 retailers in May 2022, attempting to curb the rampant overcharging. The 2022 shortage, triggered by a manufacturing plant closure and recall, left three out of four infants in the U.S. reliant on a dwindling and increasingly expensive supply. The OAG found Marine Park and Formula Depot boosted prices by over 60 percent, raking in hundreds of thousands in illicit profits.
The settlement requires Marine Park and Formula Depot to deliver the full $675,000 in baby formula by November 2025. Beyond the donation, the two companies are also barred from further price gouging. While this action provides some relief, it’s a stark reminder that when crises hit, some will always attempt to profit from the vulnerability of others.
