Philadelphia Man Sentenced to Four Years and Nine Months for Opioid Conspiracy

A 54-year-old man was sentenced to four years and nine months in prison for conspiracy to distribute oxycodone, a highly addictive controlled substance, in a case involving the notorious ’10th and O Crew’ in South Philadelphia.

Frank Procopio, the second leader of the crew to be sentenced, pleaded guilty in November 2024 to one count of conspiracy to unlawfully distribute controlled substances. His brother, Michael Procopio, was convicted of the same crime in June 2024 and sentenced to six years in prison in April 2025.

According to court documents, Procopio engaged in the unlawful sale of prescription oxycodone pills between March 2019 and March 2024. He obtained the pills from doctors’ offices in the area and distributed them from a 24-hour restaurant, often working in shifts with his co-conspirators.

Law enforcement purchased pills from one of Procopio’s co-conspirators and observed the co-conspirator dividing the proceeds with Procopio. A surveillance photograph captured Procopio counting money from a controlled buy of oxycodone pills with a co-conspirator.

The FBI, DEA, and Pennsylvania Office of Attorney General, Medicaid Fraud Control Unit investigated the case, which was prosecuted by Trial Attorneys Paul J. Koob and Nicholas K. Peone of the Criminal Division’s Fraud Section.

The Health Care Fraud Strike Force Program, which has charged over 5,800 defendants who collectively have billed federal health care programs and private insurers more than $30 billion since 2007, is also cracking down on health care fraud.
