Gustavo Mulato, a 25-year-old Mexican national, has been charged with illegal re-entry into the United States, according to a federal indictment unsealed in the Middle District of Pennsylvania.
Mulato, who was previously deported from the US to Mexico in April 2012 and twice in July 2012, is alleged to have illegally re-entered the US sometime after July 2012.
He was found in Schuylkill County, Pennsylvania, after eluding examination or inspection by immigration officers.
Mulato’s previous conviction for resisting arrest in the Luzerne County Court of Common Pleas in 2012 subjects him to enhanced penalties in the current case.
The case was investigated by U.S. Immigration and Customs Enforcement and Removal Operations (ERO), and is being prosecuted by Special Assistant United States Attorney Brian G. McDonnell.
Indictments and Criminal Informations are only allegations, and all persons charged are presumed to be innocent unless and until found guilty in court.
Under federal law, Mulato faces a maximum penalty of ten years’ imprisonment, a term of supervised release following imprisonment, and a fine.
