NEW ORLEANS, LA – Two New Orleans men are facing decades behind bars after a federal jury convicted them of terrorizing victims in back-to-back carjackings. Harold Foster, age 31, and Marc Dalton, age 31, received their sentences on April 25, 2023, from U.S. District Judge Jay C. Zainey, following a trial that laid bare their brazen disregard for human life.
The first incident occurred on April 10, 2020, at the Eastside Cash and Carry on Chef Menteur Highway. Foster and Dalton cornered the driver of a white Chevrolet Equinox, holding him at gunpoint with a revolver. They didn’t just want the vehicle; they briefly kidnapped the man before dumping him unceremoniously on the side of the road. The victim was left shaken and fearing for his life.
Just two days later, on April 12, 2020, the pair struck again. This time, two victims were sitting in a Mercedes C300 on St. Peter Street when Foster and Dalton descended upon them, brandishing a semi-automatic Taurus handgun. Again, the victims were forced into a terrifying ordeal, kidnapped, and then abandoned. But this time, their luck ran out quickly. The New Orleans Police Department located the stolen Mercedes, and after a high-speed pursuit on Downman Road, the duo was apprehended.
Federal prosecutors didn’t hold back. Foster was sentenced to a staggering 44 years imprisonment – 180 months for each of the two carjacking counts and 84 months for each count of brandishing a firearm during a crime of violence, all to run consecutively. He was also ordered to pay $400.00 in mandatory special assessment fees and will face five years of supervised release after his prison term. Dalton wasn’t far behind, receiving 41 years and 6 months imprisonment under the same sentencing structure, plus the same financial penalties and supervised release term.
U.S. Attorney Duane A. Evans praised the collaborative effort of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the New Orleans Police Department, and the Jefferson Parish Sheriff’s Office in bringing these dangerous criminals to justice. Assistant U.S. Attorneys Charles D. Strauss, David E. Haller, and J. Benjamin Myers led the prosecution, ensuring the full weight of federal law was brought down on Foster and Dalton.
These sentences send a clear message: in New Orleans, and across the Eastern District of Louisiana, violent carjacking will not be tolerated. The ATF and local law enforcement are committed to dismantling these criminal enterprises and protecting the citizens from those who seek to inflict terror on the streets. The lengthy sentences handed down to Foster and Dalton should serve as a deterrent to anyone considering a similar path.
