Harold Fuller, Jr., a 37-year-old man from Mission, South Dakota, has been charged with possession of a stolen firearm and possession of a firearm by a prohibited person.
According to a federal indictment, Fuller knowingly possessed a stolen revolver on February 22, 2016. The indictment also alleges that Fuller, having previously been convicted of a misdemeanor crime, was prohibited from possessing a firearm.
The maximum penalties upon conviction are up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund on each count. Restitution may also be ordered.
Fuller was indicted on July 19, 2016, and appeared before U.S. Magistrate Judge Mark A. Moreno on July 22, 2016, where he pled not guilty to the indictment. Fuller was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set.
The investigation is being conducted by the Rosebud Sioux Tribe Law Enforcement Services, and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant U.S. Attorney Carrie G. Sanderson is prosecuting the case.
Fuller’s charges are merely accusations, and he is presumed innocent until and unless proven guilty. The exact date of the crime is February 22, 2016, and Fuller’s current status is in the custody of the U.S. Marshals Service pending trial.
