Defendant Admits to Stealing from Labor Union

Henry Shuler, 65, of Houston, has admitted to stealing from United Transportation Union (UTU), Local 1982, announced U.S. Attorney Kenneth Magidson. Shuler was the secretary/treasurer of UTU, a position that gave him control over the union’s finances.

Agents received information from an internal UTU International auditor that Shuler embezzled union funds by writing checks to Sam’s Club for personal items not authorized by the union. Further investigation by Department of Labor (DOL) investigators revealed that Shuler also disguised some of the stolen funds as repayment of union dues to nonexistent members.

The total amount of union funds stolen is approximately $40,000 over the course of six years, according to U.S. Attorney Kenneth Magidson. The scheme was uncovered by agents who received a tip from a UTU auditor.

Shuler’s crimes were investigated by the DOL-Office of Labor Management Standards. Assistant U.S. Attorney Glenn Cook is prosecuting the case. Shuler is set to be sentenced on July 17, 2015.

Shuler faces up to five years imprisonment and a possible $10,000 maximum fine if convicted. The case highlights the need for labor unions to closely monitor their finances to prevent embezzlement.
