HOMESTEAD, FL – A Homestead resident has been handed a two-year prison sentence for possessing child pornography. Bismarck Antonio Vargas, 43, was sentenced yesterday by U.S. District Judge William P. Dimitrouleas for his role in the illegal possession of images on an Apple iPhone.
According to court documents, Vargas had a collection of 67 photos depicting child pornography, including prepubescent minors. The offensive images were uploaded to the device between July and September 2011, with Vargas subsequently accessing and saving some of these images onto his cellular telephone.
The investigation leading to Vargas’s conviction was heralded by Benjamin G. Greenberg, Acting United States Attorney for the Southern District of Florida, who commended the efforts of the FBI in bringing the case to closure. Assistant United States Attorney Joshua S. Rothstein handled the prosecution.
Vargas pleaded guilty to one count of possession of child pornography, violating Title 18, United States Code, Section 2252(a)(4)(B). In addition to his prison term, he will be subject to five years of supervised release following his release from custody.
