Jose Hernandez-Hernandez, a 35-year-old Honduran man, has been charged with illegal reentry of a removed alien, in violation of 8 U.S.C. § 1326(a), in a one-count indictment announced by U.S. Attorney Kenneth A. Polite.
According to the indictment, Hernandez-Hernandez reentered the United States after having been previously removed on July 26, 2013.
The indictment alleges that Hernandez-Hernandez, a citizen of Honduras, knowingly re-entered the United States without the permission of the U.S. Attorney General or the Secretary of Homeland Security.
U.S. Attorney Polite emphasized that an indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.
Hernandez-Hernandez faces a maximum term of imprisonment of two years, a maximum fine of $250,000, a maximum term of supervised release of one year, and a mandatory $100 special assessment if convicted.
The investigation was conducted by the United States Department of Homeland Security, Immigration and Customs Enforcement and Removal Operations.
Assistant U.S. Attorney Spiro G. Latsis is in charge of the prosecution.
Hernandez-Hernandez’s indictment serves as a reminder of the consequences of violating U.S. immigration laws.
