HOUSTON – A 34-year-old Houston resident and documented gang member, Kelvin Patton, has been sentenced to over 15 years in federal prison for a brutal robbery at a local Denny’s restaurant. The sentence was announced by U.S. Attorney Nicholas J. Ganjei.
Patton, 34, was found guilty of interference with commerce through robbery and brandishing a firearm during a crime of violence after a one-day bench trial on November 5, 2024. U.S. District Judge Alfred H. Bennett handed down an 89-month term for the robbery, to which Patton must add 96 months for the firearms charge, resulting in a total sentence of 185 months. This is followed by five years of supervised release.
The court heard evidence detailing Patton’s history of felony offenses, including multiple robberies and unlawful possession of firearms, despite being on court supervision. Judge Bennett remarked that Patton was on a path leading to either life imprisonment or an early death.
From 2019 to 2022, Patton committed several felonies, including robbery, vehicle theft, and unlawful possession of firearms and body armor, all while released on bond. Following his release for the weapons charge, Patton followed a Denny’s manager from a bank to the restaurant on Hillcroft Ave., where he struck the manager with a firearm and stole a bank bag before fleeing.
Patton was later observed looking into vehicles outside a bank and was taken into custody after authorities identified him. At trial, the defense argued that the robbery fell outside federal jurisdiction; however, the court found Patton guilty as charged.
This conviction makes it unlawful for Patton to possess firearms or ammunition under federal law. As a convicted felon, he will remain in custody pending transfer to a Federal Bureau of Prisons facility. The investigation was conducted by the Houston Police Department with assistance from the U.S. Marshals Service, and Assistant U.S. Attorney Stuart Tallichet prosecuted the case.
