Aryan Deshwal, Alien Smuggling, NY 2024

ALBANY, NEW YORK – In a harrowing turn of events on November 21, 2024, Aryan Deshwal, a 21-year-old Indian citizen, pleaded guilty to conspiracy to commit alien smuggling and five counts of alien smuggling. The announcement was made by Acting United States Attorney John A. Sarcone III and Chief Patrol Agent Robert Garcia of the U.S. Border Patrol’s Swanton Sector.

Deshwal admitted to picking up five immigrants who had just crossed the border from Canada into the United States. In a high-speed chase with the Border Patrol, Deshwal lost control of his vehicle, causing it to flip and catch fire. Both he and the passengers were hospitalized, one requiring emergency surgery.

Acting United States Attorney Sarcone emphasized the dangers of alien smuggling, stating, “This case illustrates how smuggling networks put people at risk for profit. Deshwal endangered the lives of the illegal aliens he picked up, Border Patrol agents, and innocent civilians.”

Patrol Agent in Charge Raymond Bresnahan highlighted the recklessness of human smugglers, noting that “smugglers do not care about the countless lives they put at risk for profit. Thankfully, our agents were nearby to provide emergency aid.”

Deshwal faces a minimum of 5 years and up to 15 years in prison during his sentencing on December 16, 2025. The investigation was conducted by Border Patrol, with Assistant U.S. Attorney Douglas Collyer prosecuting the case.
