Jose Antonio Barcena-Ruiz, Alien Smuggling, New York 2024

BUFFALO, N.Y. – The grimy streets of Buffalo witnessed a pivotal plea deal as Jose Antonio Barcena-Ruiz, 41, a citizen and national of Mexico, stood before U.S. District Judge Richard J. Arcara. Barcena-Ruiz’s admission of guilt for illegal re-entry marks another blow in the ongoing battle against transnational criminal organizations (TCOs).

Michael DiGiacomo, U.S. Attorney, announced that the defendant was sentenced to time served and subsequently handed over to Immigration and Customs Enforcement (ICE). ‘This sentence sends a clear message that the Department of Justice is committed to protecting our communities from those who attempt illegal entry,’ DiGiacomo stated.

According to Special Assistant U.S. Attorney Michael J. Smith, Barcena-Ruiz was apprehended by Homeland Security agents in Erie County, NY, on May 31, 2025. The defendant was found without legal documentation, a stark contrast to his previous physical removals from the United States in 2008, 2009 (twice), and 2010.

This investigation falls under Operation Take Back America, an aggressive nationwide initiative led by the Department of Justice. The operation aims to repel illegal immigration, eliminate cartels, and safeguard communities from violent crime.

Smith emphasized that Homeland Security Investigations, directed by Special Agent-in-Charge Erin Keegan, played a crucial role in this case, alongside Immigration Enforcement. ‘Our efforts are unwavering in ensuring the rule of law and public safety,’ Smith concluded.

The plea and sentencing reflect the relentless pursuit of justice against those who flout immigration laws. Barcena-Ruiz’s fate underscores the government’s commitment to upholding the integrity of our borders and protecting American citizens from illegal activities.
