David Pastorello, Child Enticement and Child Pornography Distribution, California 2023

Syracuse, NEW YORK – David Pastorello, 42, of Ithaca, was taken into custody Tuesday for federal charges of enticement of a minor and distribution of child pornography. The grim revelations about Pastorello’s actions began when he texted an underage girl, repeatedly soliciting sex and sharing indecent images of himself. He escalated by sending two images classified as child pornography under federal law and entered the victim’s apartment without permission before fleeing.

Pastorello has a prior record, having been arraigned in Tompkins County Court for possessing a sexual performance by a child under 16. In July, he pled guilty to disseminating indecent material to a minor in Cortland County, with sentencing pending. Despite these offenses, Pastorello was allowed out on bond.

Acting United States Attorney John A. Sarcone III emphasized the need for swift action by law enforcement, stating that children have been protected and a dangerous predator apprehended. FBI Special Agent in Charge Craig L. Tremaroli highlighted the collaboration between agencies, noting their commitment to stopping predators seeking to harm children.

Pastorello faces life imprisonment for enticement of a minor and 20 years for distribution of child pornography. Sentencing is at the discretion of the judge based on the particular statute(s) violated. He must register as a sex offender if convicted.

The FBI and New York State Police are investigating, with Assistant U.S. Attorney Ben Gillis prosecuting under Project Safe Childhood, a nationwide initiative to combat child sexual exploitation and abuse. For more information, visit Project Safe Childhood.
