Tampa, Florida – Jacquelyn DeVito, a 40-year-old former nurse from Brandon, has been sentenced to 24 months in federal prison for her role in an oxycodone prescription scheme. DeVito pleaded guilty on December 9, 2022, and has since relinquished her Nurse Practitioner and Advanced Registered Nurse Practitioner licenses to the State of Florida Board of Nursing.
According to court documents, DeVito worked as a nurse at an urgent care medical office in Tampa from March 2020 to June 2022. During this time, she offered patients separate home health services through her privately-owned company, Bee Home Medical LLC. DeVito used the patients’ names and dates of birth to prescribe oxycodone, a Schedule II controlled substance, without their knowledge or consent.
DeVito would then issue the prescriptions to local retail pharmacies and pick them up by falsely stating that she was the patients’ caregiver. This resulted in over 2,900 oxycodone pills being prescribed and acquired by DeVito. Many of the victim patients had no knowledge that DeVito had issued the prescriptions in their names and confirmed that there was no legitimate need for them to receive the medication.
The case was investigated by the Drug Enforcement Administration (Tampa District Office) and the Opioid Fraud and Abuse Detection Unit. The Opioid Fraud and Abuse Detection Unit was created to help combat the devastating opioid crisis and focuses specifically on opioid-related health care fraud.
The case was prosecuted by Assistant United States Attorney Greg Pizzo. DeVito’s sentence marks a significant blow to the opioid epidemic, which has ravaged communities across the United States.
DeVito’s actions demonstrate a blatant disregard for the law and the well-being of her patients. Her sentence serves as a reminder that those who engage in such activities will be held accountable for their actions.
