Muskogee, Oklahoma – In a shocking turn of events, James DeWayne Marshall, a 33-year-old man from Eufaula, Oklahoma, has pleaded guilty to possessing a firearm in furtherance of a drug trafficking crime.
The charges against Marshall arose from an investigation by the Carter County Sheriff’s Department, the Ardmore Police Department, the United States Marshal Service, and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
According to the indictment, on or about February 5, 2014, Marshall knowingly possessed a Ruger, model P95, 9mm caliber pistol, in furtherance of a drug trafficking crime for which he may be prosecuted in a court of the United States, that is, Possession of a Controlled Substance with Intent to Distribute.
The Honorable Stephen P. Shreder, District Judge in the United States District Court for the Eastern District of Oklahoma, in Muskogee, accepted the guilty plea and ordered the completion of a presentence report. Sentencing will be scheduled following its completion.
Marshall will remain in the custody of the United States Marshal Service pending sentencing.
The statutory range of punishment is not less than 5 years imprisonment and/or up to a $250,000.00 fine.
