New York – In a stunning display of disregard for tenant rights, Landsman Real Estate Services, Inc., and Landsman Development Corp. (collectively, ‘Landsman’) have been caught in a web of neglect that left 25 low-income families in Rochester without homes.

Attorney General Letitia James announced today that she has secured new protections for the affected tenants after an investigation revealed that Landsman failed to properly notify them of their rights before forcing them out of their affordable housing units. The townhomes, part of the Los Flamboyanes affordable housing complex, were set to be demolished and redeveloped by Landsman.

The story takes a darker turn as it emerges that Landsman not only violated the law by failing to inform tenants of their right to return to the newly built homes but also failed to provide adequate relocation payments. The settlement ensures that tenants will be informed of their right to return when construction is estimated to be completed in April 2027.

“No one should be forced out of their home and denied the necessary resources to find a safe and affordable place to live,” said Attorney General James. “Today’s agreement puts money back in the pockets of Los Flamboyanes tenants who were misinformed of their rights and denied full relocation payments.”

Landsman first informed the tenants they might be displaced due to a renovation project in April 2024. In December 2024, a 90-day notice was issued for tenants to vacate by March 31, 2025. The investigation found these notices were illegal as they did not fully inform tenants of their rights.

Attorney General James has secured a second settlement with Landsman to ensure that all eligible tenants receive additional compensation and are informed of their right to return to their homes once construction is completed. This comes after an initial agreement in April 2025, which provided over $271,000 in additional Replacement Housing Payments for those whose costs exceeded the lump sum payments from Landsman.
