Jason Lee Gordon, Firearm Possession, West Virginia 2022

MARTINSBURG, W.Va. — Jason Lee Gordon, a 36-year-old Rio man with a history of domestic violence, is facing federal charges for illegally possessing nine firearms, including a ghost gun, discovered during a drunken driving arrest in April 2022.

According to court documents, law enforcement responded to a domestic disturbance in Hampshire County that led to a high-tension scene when Gordon drove his vehicle into a ditch. Officers arrested him on suspicion of driving under the influence and, during a search of the car, uncovered nine loaded firearms and multiple rounds of ammunition stashed inside.

One of the weapons was a privately manufactured firearm, commonly known as a ghost gun, untraceable by serial number. The remaining eight were standard-issue firearms, all illegally in Gordon’s possession due to a prior domestic violence conviction out of Mineral County that bars him from owning or handling guns under federal law.

Gordon is charged with being a prohibited person in possession of a firearm, a felony offense carrying significant prison time. He remains locked up in the Eastern Regional Jail and is scheduled to appear in federal court for arraignment on February 2.

“The prosecution of domestic abusers with guns continues to be a priority for my office,” said United States Attorney William Ihlenfeld. “Every case like this that we bring makes the community safer, not only for victims but also for the law enforcement officers who respond to domestic calls.”

The investigation was a joint effort by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the Hampshire County Sheriff’s Office, and the Hardy County Sheriff’s Office. Assistant U.S. Attorney Eleanor F. Hurney is prosecuting the case. An indictment is not a conviction—Gordon is presumed innocent until proven guilty in a court of law.
