Assault on Federal Officer Rocks New Mexico Community
A disturbing incident of violence against law enforcement has shaken a New Mexico community. Gerald Toya, a 40-year-old enrolled member of Jemez Pueblo, has pleaded guilty to assaulting a federal officer.
According to court documents, Toya was arrested on May 24, 2018, on a two-count indictment charging him with assaulting a federal officer and assault with a dangerous weapon. The alleged offenses took place on November 28, 2017, on the Jemez Pueblo in Sandoval County, New Mexico.
Toya’s guilty plea, entered on August 31, 2018, admitted that he threw a glass bottle at a federal law enforcement officer engaged in the performance of his official duty. The glass bottle struck the officer in the hip, causing harm.
The Pueblo of Jemez Tribal Police Department led the investigation into Toya’s actions, and Assistant U.S. Attorney Joseph M. Spindle is prosecuting the case.
Toya’s sentencing hearing has yet to be scheduled, but he faces a maximum penalty of 20 years in federal prison. He remains in custody pending the hearing.
The incident raises concerns about the safety of law enforcement officers in the region and highlights the need for increased measures to protect those who serve and protect the community.
Toya’s case serves as a reminder that violence against law enforcement will not be tolerated and that those who commit such crimes will face the full force of the law.
