EAGLE BUTTE, SD – Jeremiah Iron Moccasin, 39, is headed to federal prison after being sentenced for illegally possessing a handgun while battling a methamphetamine addiction. Chief Judge Roberto A. Lange handed down the 13-month sentence on January 3rd, followed by three years of supervised release. The case underscores the ongoing struggle with drug-related crime impacting tribal lands in South Dakota.
The bust originated on March 24, 2023, when Cheyenne River Sioux Tribe Law Enforcement Services arrested Iron Moccasin on an outstanding tribal warrant. During a search at the jail, officers discovered a .22 Arminius HW7, GmbH revolver inside his backpack, along with methamphetamine and syringes. Iron Moccasin readily admitted to years of methamphetamine use, immediately disqualifying him from legally owning a firearm under federal law.
Federal prosecutors detailed how Iron Moccasin’s addiction directly led to the violation. He was indicted by a federal grand jury in July 2023 and ultimately pleaded guilty on October 2, 2023. The sentencing also included a $100 assessment to the Federal Crime Victims Fund and forfeiture of the seized firearm. The weapon will likely be destroyed, another casualty of the cycle of addiction and crime.
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) joined forces with the Cheyenne River Sioux Tribe Law Enforcement Services to build the case. Assistant U.S. Attorney Meghan N. Dilges led the prosecution, highlighting the collaborative effort between federal and tribal agencies to address gun violence. The investigation demonstrates a commitment to keeping firearms out of the hands of those legally barred from possessing them.
U.S. Attorney Alison J. Ramsdell framed the case as part of “Project Safe Neighborhoods,” a nationwide initiative aimed at reducing violent crime and gun violence. The program emphasizes community partnerships, focused enforcement, and measurable results. Despite the program’s goals, the continued flow of drugs and firearms into communities like Eagle Butte remains a significant challenge.
Iron Moccasin was immediately taken into custody by the U.S. Marshals Service to begin serving his sentence. While the 13-month term offers a measure of accountability, it remains to be seen whether the system can provide the necessary resources for Iron Moccasin to address his addiction and avoid further entanglement with the law. The case serves as a stark reminder of the complex interplay between substance abuse, criminal activity, and the need for comprehensive solutions.
