Defendant’s Guilty Plea Sends Shockwaves through Dracut Community
John F. Paczkowski, a 73-year-old attorney from Dracut, Massachusetts, pleaded guilty in U.S. District Court in Boston to two counts of filing false personal tax returns for 2009 and 2010.
According to court documents, Paczkowski operated a sole practitioner legal office in Dracut, where he was required to hold client funds in a trust account separate from his own funds. However, an investigation revealed that Paczkowski embezzled and misappropriated funds from the trust account, using clients’ money for his own purposes.
The attorney failed to report more than $630,000 in embezzled funds to the IRS and failed to pay over $192,000 in federal taxes. The charging statute provides for a sentence of no greater than three years in prison, one year of supervised release, and a fine of $250,000.
U.S. District Judge George A. O’Toole has scheduled sentencing for February 16, 2017. Assistant U.S. Attorney Victor A. Wild of U.S. Attorney Carmen M. Ortiz’s Economic Crimes Unit prosecuted the case.
The investigation was conducted by the Internal Revenue Service’s Criminal Investigation in Boston, led by Special Agent in Charge Joel P. Garland.
