John Gerald Oakley, Tax Evasion, Michigan 2024

GRAND RAPIDS, MICHIGAN

A high-profile case in Michigan has culminated in a guilty plea from a former CEO, resulting in a severe penalty for tax evasion. John Gerald Oakley, the 66-year-old former Chief Executive Officer of Michigan BioDiesel, has been sentenced to a year and a day in prison for his role in evading federal taxes.

According to court documents, Oakley and his company, Michigan BioDiesel, claimed to be producing an alternative fuel mixture that qualified as an excise tax-exempt fuel. However, this claim was found to be a ruse, and the company received $1,867,122.50 in tax refunds that it was not entitled to. Additionally, Oakley was ordered to pay back approximately $56,000 in personal federal taxes owed by him, bringing the total restitution to $1,923,443.50.

The case against Oakley was handled by Assistant U.S. Attorneys Michael A. MacDonald, Sally J. Berens, and Hagen W. Frank. Acting U.S. Attorney Andrew Birge emphasized that his office will zealously prosecute crimes against the United States Treasury, stating, ‘Cheating on your taxes is stealing from your neighbors.’

A co-defendant, Tracy Darin Daniels, a 50-year-old resident of Mississippi, was also sentenced in connection with the case. Daniels was given two years of probation for misprision of a bankruptcy fraud, a charge stemming from the submission of false documents in a United States Bankruptcy Court case in the Western District of Michigan.

The case serves as a stark reminder of the consequences of tax evasion and the importance of upholding the integrity of the U.S. Treasury. With a total restitution of nearly $2 million, Oakley’s sentence is a significant blow to those who would seek to cheat the system.
