CONCORD – A disturbing case of unlawful reentry has shaken the community, with a Guatemalan national being sentenced for re-entering the United States illegally. Jorge Misael Niz, a 43-year-old Guatemalan national, was arrested on April 27, 2025, after a domestic violence incident in Salem, New Hampshire.
Niz, who was previously ordered to be removed from the United States by an Immigration Judge, had been deported to Guatemala on March 30, 2006. However, he managed to re-enter the country, prompting the Salem Police Department to refer him to Immigration and Customs Enforcement (ICE) after learning of his immigration status.
ICE led the investigation, with the Salem Police Department providing valuable assistance. Assistant U.S. Attorney Matthew Vicinanzo prosecuted the case.
Niz pleaded guilty and was sentenced by U.S. District Court Judge Samantha D. Elliott to time served, or two months. He is currently in the custody of ICE for removal to Guatemala.
This case is part of Operation Take Back America, a nationwide initiative that aims to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.
Operation Take Back America streamlines efforts and resources from the Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).
