Juan Otero, Dealing in Firearms without a License, Massachusetts 2024

FRANKLIN, MA – Juan Otero, 22, is facing federal charges after allegedly continuing to deal firearms even while awaiting trial in state court on separate gun and assault offenses. Federal authorities allege Otero sold five firearms between November 2023 and January 2024, brazenly flouting the law and endangering public safety.

According to charging documents filed in U.S. District Court, the illegal sales took place over four separate occasions. The most alarming allegation? One of the firearms was a Glock pistol equipped with a “Glock switch,” a device that converts the weapon into a machinegun, effectively turning a handgun into a fully automatic weapon. Otero is also accused of selling large capacity magazines and ammunition, fueling the potential for mass violence.

This wasn’t a one-off slip-up. Otero was already under indictment in Worcester Superior Court since 2022, facing charges of unlawful possession of a large capacity weapon, a loaded firearm, and large capacity firearm and ammunition, as well as attempted assault and battery. He was released pending trial on those charges – a fact that appears to have done little to deter his alleged criminal activity.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), along with the Massachusetts State Police and Worcester Police Department, led the investigation. The Drug Enforcement Administration (DEA), and the Franklin, Mansfield and Auburn Police Departments also provided assistance. The case highlights the ongoing struggle to keep illegal firearms off the streets and the challenges posed by individuals released pending trial who continue to engage in criminal behavior.

If convicted, Otero faces up to five years in prison for each charge – dealing in firearms without a license and receiving a firearm while under indictment – along with up to three years of supervised release and a fine of up to $250,000. Sentencing will be determined by a federal judge considering U.S. Sentencing Guidelines and applicable statutes. U.S. Attorney Joshua S. Levy and ATF Special Agent in Charge James M. Ferguson announced the charges on Monday.

This case is being prosecuted under Project Safe Neighborhoods (PSN), a Department of Justice program aimed at reducing violent crime and gun violence through collaboration between law enforcement and communities. However, the fact remains: a man facing serious firearm and assault charges was allegedly able to acquire and sell more guns, raising serious questions about the effectiveness of the current system. It’s important to remember that these are allegations, and Otero is presumed innocent until proven guilty beyond a reasonable doubt.
