Juviny Calix-Cruz, Illegal Reentry, Virginia 2024

NORFOLK, Va. — Juviny Calix-Cruz, a 42-year-old Honduran citizen, pleaded guilty today to illegally reentering the United States after being deported multiple times, court records show. The admission comes as he faces separate state charges for alleged sexual offenses against a child under 13 years old — a case that has reignited scrutiny over repeat immigration violators with violent criminal histories.

According to federal prosecutors, Calix-Cruz first entered the U.S. illegally in 2005. He was deported at taxpayer expense in June 2012, only to illegally return weeks later. A second deportation followed in July 2012. Despite these removals, he resurfaced in Norfolk in 2019, where he was arrested and later indicted by a state grand jury on charges of forcible sodomy and taking indecent liberties with a child by a person in a custodial or supervisory relationship.

“Calix-Cruz has been deported at taxpayer expense on multiple occasions,” said U.S. Attorney G. Zachary Terwilliger. “Additionally, he has been charged in state court with allegations of committing serious sex offenses against a minor. This prosecution and guilty plea show that the United States will continue to hold accountable those who disregard our nation’s borders and laws.”

Lyle A. Boelens, Acting Field Office Director for U.S. Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operations (ERO) Washington, D.C., emphasized the dual threat posed by Calix-Cruz. “This individual not only disregarded the nation’s immigration laws, but also committed criminal acts against an innocent child while in the country illegally,” Boelens said. “ICE will continue to target convicted criminal aliens like Calix-Cruz for arrest, prosecution and removal from the United States.”

Calix-Cruz pleaded guilty to illegal reentry by a removed alien, a federal charge carrying a maximum penalty of two years in prison. He is scheduled to be sentenced on September 6 before a federal district court judge. While federal sentences often fall below the statutory maximum, the court will weigh the U.S. Sentencing Guidelines, prior removals, and pending state charges in determining the final term.

The case was announced by U.S. Attorney G. Zachary Terwilliger and Michael K. Lamonea, Assistant Special Agent in Charge of ICE’s Homeland Security Investigations (HSI) Norfolk, after U.S. Magistrate Judge Douglas E. Miller accepted the guilty plea. Assistant U.S. Attorney Daniel P. Shean is prosecuting. Court documents are available in the Eastern District of Virginia’s federal docket under Case No. 2:19-cr-60 via PACER.
