James Wiley Kelley Jr., Machinegun Possession, Florida 2024

TALLAHASSEE, FL – James Wiley Kelley, Jr., 50, of Altha, Florida, is facing serious federal heat after being indicted on charges of possessing an unregistered National Firearms Act (NFA) weapon, a machinegun, and firearms/ammunition as a convicted felon. The feds aren’t playing around with this one.

United States Attorney for the Northern District of Florida, John P. Heekin, announced the charges today, detailing a case built by U.S. Immigration and Customs Enforcement’s Homeland Security Investigations (HSI) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The Calhoun County Sheriff’s Office also pitched in. Kelley, Jr. made his first court appearance on September 24, 2025, before Magistrate Judge Martin A. Fitzpatrick.

If Kelley, Jr. is convicted on all counts, he’s looking at a substantial stretch behind bars. Up to 10 years for the unregistered NFA weapon, another 10 for the machinegun, and a whopping 15 years for being a felon in possession of firearms and ammo. That’s a potential 35-year sentence for a man already with a record.

Assistant United States Attorney Jason R. Coody is leading the prosecution, and he’ll have his work cut out for him. This case is reportedly part of “Operation Take Back America,” a nationwide initiative designed to crack down on illegal immigration, dismantle cartels, and target violent crime. It’s a broad sweep, and Kelley, Jr. is now caught in the net. The operation leverages resources from the Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhoods.

Let’s be clear: an indictment is just an accusation. Kelley, Jr. is presumed innocent until proven guilty. The government bears the burden of proof – they have to convince a jury, beyond a reasonable doubt, that he committed these crimes. A jury trial is scheduled for November 27, 2025, before District Court Judge Mark E. Walker. Expect a full-blown courtroom battle.

The United States Attorney’s Office for the Northern District of Florida is one of 94 nationwide, and they’re the primary federal litigators in the state.
