Largo Felon Sentenced for Loaded Firearm Possession

Tampa, Florida – U.S. District Judge Susan C. Bucklew has sentenced Michael Kelly (29, Largo) to 5 years and 10 months in federal prison for possessing a firearm and ammunition as a convicted felon.

The Court also ordered him to forfeit the firearm and ammunition. Kelly was indicted on March 9, 2016, and convicted on June 29, 2016, after a jury trial.

According to court documents, on October 15, 2015, FBI agents executed a search warrant at Kelly’s home and recovered a semi-automatic pistol from his bedroom. The firearm was loaded and contained nine rounds of 9mm ammunition. Agents also recovered three boxes of ammunition, containing a total of 150 rounds, from the top of his dresser.

Kelly has multiple prior felony convictions, including possession of a sawed-off shotgun and aggravated assault, and is therefore prohibited from possessing a firearm or ammunition under federal law.

This case was investigated by the Federal Bureau of Investigation and the Pinellas County Sheriff’s Office. It is being prosecuted by Assistant United States Attorneys Kaitlin R. O’Donnell and Simon A. Gaugush.

As a convicted felon, Kelly should have known better than to possess a loaded firearm. Instead, he decided to recklessly disregard the law and put himself and others at risk. His sentence is a reminder that the consequences of such actions are severe and will be enforced by law enforcement.

Michael Kelly will serve his sentence at a federal institution. He has been advised of his right to appeal the verdict.
