Marquis Lamar McDuffie, Possessing a Firearm as a Convicted Felon, North Carolina 2020

A loaded handgun and a history of violence led to an 8 ½ year prison sentence for Marquis Lamar McDuffie, a Connecticut man, in the Eastern District of North Carolina.

McDuffie, 35, was sentenced to 102 months in prison after pleading guilty to possessing a firearm despite being a previously convicted felon.

On May 3, 2020, Greenville Police officers attempted to conduct a lawful traffic stop on a vehicle operated by McDuffie, but he attempted to flee and threw a loaded handgun over a fence, narrowly avoiding two children who were playing outside. The firearm was quickly secured by police officers.

A search of McDuffie’s vehicle yielded quantities of marijuana, MDMA, and crack cocaine. McDuffie was on federal supervised release from Connecticut for a prior firearm conviction at the time of the incident.

G. Norman Acker, III, Acting U.S. Attorney for the Eastern District of North Carolina, praised the cooperation between local law enforcement and federal agencies in bringing McDuffie to justice.

“This case highlights the serious consequences of possessing a firearm as a convicted felon,” Acker said. “We will continue to work tirelessly to keep our communities safe from those who seek to exploit the law for their own gain.”

Assistant U.S. Attorney Aakash Singh prosecuted the case, which was investigated by the Greenville Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives. The case was handled by Chief U.S. District Judge Richard E. Myers II.
