Robert Ashton Kerns, 23, of Long Beach, Mississippi, is headed to federal prison for 46 months after being caught with nearly 1,800 counterfeit pills laced with fentanyl — a haul that could have killed dozens. U.S. District Judge Sul Ozerden handed down the sentence today, sealing Kerns’ fate in a case that began with a near-fatal overdose in a Sonic Drive-In parking lot.
The arrest came April 17, 2018, when Gulfport police responded to a report of a man unconscious behind the wheel of a running car. That man was Kerns, slumped in the driver’s seat, barely breathing. Inside the vehicle, officers found approximately 300 fake oxycodone pills and over 1,500 counterfeit Xanax tablets. What looked like prescription medication was, in reality, a death trap — lab tests later confirmed the pills contained fentanyl and fentanyl analogues, opioids so potent they can kill in milligram doses.
Kerns was charged on June 12, 2018, in a federal indictment for possession with intent to distribute fentanyl and fentanyl analogues. He admitted guilt on March 1, 2019, pleading guilty to a single count that carried serious federal time. His decision to plead came as evidence mounted from both local and federal investigators who traced the source of the counterfeit supply to underground labs flooding the black market with fake pharmaceuticals.
The Drug Enforcement Administration, working alongside the Gulfport Police Department, led the investigation into Kerns’ operation. Authorities believe he wasn’t just a low-level dealer but part of a broader distribution chain pushing deadly counterfeits into South Mississippi. These pills, often indistinguishable from the real thing, have fueled a surge in overdoses across the state and nationwide.
Assistant U.S. Attorney John Meynardie prosecuted the case, arguing that Kerns’ actions posed a grave danger to public safety. “These weren’t just drugs — they were disguised weapons,” Meynardie said in court. “Each pill had the potential to end a life.” The prosecution pushed for a sentence that reflected the lethal nature of the contraband, resulting in 46 months behind bars followed by three years of supervised release.
The case underscores the growing threat of counterfeit pharmaceuticals in the opioid epidemic. Federal and local agencies continue to warn the public: pills bought outside legitimate pharmacies are playing Russian roulette with users’ lives.
