BROOKLYN, NY – Luis Rosario, a convicted felon, is facing federal charges after allegedly shooting a man in the leg and then deliberately driving over his foot in a shocking act of violence in Brooklyn’s Red Hook neighborhood on December 3, 2023. The brazen attack, captured on surveillance video, has sparked outrage and led to a swift response from federal and local authorities.

According to the indictment unsealed today at the federal courthouse, Rosario allegedly opened fire on three men standing outside a supermarket and restaurant. Witnesses and footage show Rosario pulling a gun and firing multiple shots while pedestrians walked nearby. One man was struck in the leg and fell to the sidewalk. But the assault didn’t end there. As the victim lay wounded, Rosario allegedly got into his car and intentionally drove it over the man’s foot, compounding the brutal attack.

Breon Peace, U.S. Attorney for the Eastern District of New York, announced the charges alongside Tommy Kalogiros, Assistant Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) New York Field Division, and Edward A. Caban, Commissioner of the New York City Police Department (NYPD). “As alleged, Rosario is a convicted felon who shot and injured a man in broad daylight…without regard for the victim or passersby,” Peace stated. “This demonstrates the important work that this office and our law enforcement partners are doing to reduce gun violence in our communities.”

Rosario’s criminal history is a key component of the case. He was previously convicted on June 20, 2016, in Bronx County Supreme Court of knowingly making or possessing dangerous contraband in prison in the first degree. This prior conviction is central to the current federal charge of being a felon in possession of ammunition, which carries a significant penalty. ATF officials emphasized their dedication to targeting the drivers of violent crime.

“The callous disregard for life will not be tolerated,” declared ATF Assistant Special Agent in Charge Kalogiros. The investigation involved a multi-agency task force including the NYPD’s Brooklyn South Violent Crime Squad, the 76th Precinct, the Drug Enforcement Administration, U.S. Marshals Service, and the U.S. Secret Service. Commissioner Caban added that the NYPD “continues its tireless efforts to rid our communities of gun violence.”

If convicted, Luis Rosario faces up to 15 years in prison. The case is being prosecuted as part of Project Safe Neighborhoods (PSN), a federal program aimed at reducing violent crime through collaboration between law enforcement agencies and local communities. Rosario was arrested this morning and is expected to be arraigned later today before U.S. Magistrate Judge Peggy Kuo. He is presumed innocent until proven guilty.
