U.S. Magistrate Judge William D. Gerdes sentenced Joey White Eagle, age 32, of Fort Totten, North Dakota to a maximum of six months in custody, a $5,000 fine, restitution, and a $10 assessment to the Victim Assistance Fund on May 30, 2013 for Assault by Striking, Beating and Wounding. White Eagle, a participant in a gang fight between the Little Eagle and White Eagle families, pleaded guilty to the charge on March 7, 2013.
The assault occurred on April 24, 2010, at Bullhead, South Dakota. U.S. Attorney Brendan V. Johnson said, “The conviction sends a message that violence will not be tolerated in our communities.”
Assistant U.S. Attorney Mikal Hanson prosecuted the case. “We commend the Federal Bureau of Investigation and the Bureau of Indian Affairs, Standing Rock Agency, on their thorough investigation, which led to the conviction of White Eagle,” Hanson said.
White Eagle was remanded to the custody of the U.S. Marshal pending sentencing. A presentence investigation was conducted prior to sentencing.
According to court documents, the fight involved the Little Eagle family and their supporters and the White Eagle family and their supporters. The investigation revealed that White Eagle was involved in the altercation.
The case is a reminder that violence has serious consequences. White Eagle’s conviction serves as a warning to those who engage in gang-related activities.
The U.S. Attorney’s Office will continue to work with law enforcement agencies to bring perpetrators of violent crimes to justice.
