Man Sentenced for Possession of Firearm
A 43-year-old Cross Hill man has been sentenced to 15 years in prison for being a felon in possession of a firearm.
Michael Jerome Davis, a resident of Cross Hill, South Carolina, was sentenced in federal court in Anderson, South Carolina, for violating 18 U.S.C. § 922(g), which prohibits felons from possessing firearms.
United States District Judge Timothy M. Cain handed down the sentence, which includes 180 months in federal prison followed by supervised release.
The conviction stems from an incident that occurred on August 7, 2017, in Clinton, South Carolina. Clinton Public Safety officers conducted a traffic stop on Davis after he attempted to drive away from a residence where he and another male were seen acting suspiciously. Officers observed what they believed to be a firearm on the passenger side floorboard of the vehicle, and a search revealed a Smith and Wesson .40 caliber pistol under the driver’s seat.
Davis is prohibited from possessing firearms due to prior separate state convictions for Pointing and Presenting a firearm, Possession with Intent to Distribute Methamphetamine, Manufacturing Methamphetamine, and Assault and Battery 1st degree.
The case was investigated by the Clinton Public Safety Department, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), and was prosecuted as part of the joint federal, state and local Project CeaseFire initiative. This initiative aggressively prosecutes firearm cases and is part of Project Safe Neighborhoods (PSN), a program aimed at reducing violent crime and making neighborhoods safer.
Assistant United States Attorney Max Cauthen of the Greenville office prosecuted the case, which was announced by United States Attorney Sherri A. Lydon. The reinvigoration of PSN was announced by Attorney General Jeff Sessions in October 2017, as part of efforts to address rising violent crime in America.
