ALBANY, NEW YORK – A Plattsburgh man has been locked up for possessing a firearm, despite being a user of marijuana, a controlled substance.
Marc T. Woodley, age 32, was sentenced to 16 months in prison for possessing a Mossberg shotgun on June 22, 2015, after he called Plattsburgh Police to report a burglary at his apartment.
Responding officers found nearly a pound of marijuana and the shotgun in Woodley’s bedroom. A further search of Woodley’s apartment revealed multiple smoking devices and a digital scale. As part of the burglary investigation, officers determined that an additional one and a half pounds of marijuana had been stolen from Woodley.
As a user of marijuana, a controlled substance, Woodley was federally prohibited from possessing the Mossberg shotgun. This restriction is a clear indication that the defendant was involved in illicit activities.
Chief United States District Judge Glenn T. Suddaby also ordered Woodley to serve 3 years of post-imprisonment supervised release.
This case was investigated by the Plattsburgh Police with assistance from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), and was prosecuted by Assistant U.S. Attorney Douglas Collyer.
The Plattsburgh Police Chief, Ken Parkinson, praised the collaborative effort between law enforcement agencies, stating that their dedication to keeping the community safe has led to another successful conviction.
