Ricky Lee Clark, 42, of St. Albans, West Virginia, is facing serious consequences after pleading guilty to a federal gun crime. Clark, a convicted felon, was found in possession of a loaded pistol on October 15, 2021, on a residential street in St. Albans.
According to court documents and statements made in court, Clark was carrying a loaded Davis Industries, model P380, .380-caliber pistol in his waistband when law enforcement officers encountered him. This was a blatant disregard for federal law, which prohibits a person with a prior felony conviction from possessing a firearm or ammunition.
Clark’s felony conviction for possession with intent to deliver a controlled substance in Kanawha County Circuit Court on June 24, 2020, made him well aware of his prohibited status. However, he chose to ignore this and carry a loaded pistol in public.
The consequences of Clark’s actions are severe. He is scheduled to be sentenced on October 13, 2022, and faces a maximum penalty of 10 years in prison, three years of supervised release, and a $250,000 fine.
United States Attorney Will Thompson commended the St. Albans Police Department for conducting the investigation and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) for providing valuable assistance. Chief United States District Judge Thomas E. Johnston presided over the hearing, while Assistant United States Attorney Nowles Heinrich prosecuted the case.
