Margate Firefighter Admits $7M Health Fraud Conspiracy

CAMDEN, N.J. – Michael Sher, 40, of Northfield, New Jersey, a firefighter by trade, is trading in his helmet for a federal prison jumpsuit after admitting to a brazen $7 million health care fraud. Sher pleaded guilty today before U.S. District Judge Robert B. Kugler to conspiracy to commit health care fraud, a scheme that preyed on New Jersey’s state health benefits programs. The case, a joint effort by the U.S. Attorney’s Office and the New Jersey Attorney General’s Office, exposes a deep network of corruption reaching into the public sector.

The scheme wasn’t a spur-of-the-moment decision, according to U.S. Attorney Craig Carpenito. Sher wasn’t just filling prescriptions; he was actively cultivating a network. “Michael Sher paid kickbacks to patients, gave an envelope of cash to a medical doctor who caused thousands of fraudulent compounded medication prescriptions to be filled, and actively recruited others below him as part of the conspiracy to defraud New Jersey state health benefits programs,” Carpenito stated. The operation targeted New Jersey state and local government employees, teachers, firefighters, police, and state troopers—exploiting their insurance coverage for unnecessary and expensive compounded medications.

The fraud centered around an out-of-state pharmacy, dubbed the “Compounding Pharmacy” in court documents, which dispensed pricey creams – for pain, scars, fungal infections, even libido – and vitamin combinations. These prescriptions, often for one-month supplies, carried price tags in the thousands of dollars. Sher and his co-conspirators knew these medications were medically unnecessary but pushed them on individuals covered by the State Health Benefits Program and the School Employees’ Health Benefits Program, managed by the “Pharmacy Benefits Administrator.” The administrator then footed the bill, ultimately costing the State of New Jersey millions.

“It is unconscionable for a public servant to defraud the very public he swore to protect, yet that is exactly what Michael Sher did,” Carpenito added, highlighting the betrayal of trust inherent in the case. The network wasn’t limited to Sher; the investigation revealed a web that included fellow firefighters, a guidance counselor, a teacher, a doctor, and multiple pharmaceutical employees. This speaks to the scale of the conspiracy and the resources dedicated to dismantling it. Sher himself raked in $1.7 million for his role as a recruiter, incentivizing others to participate in the illegal scheme.

Federal investigators were unequivocal in their condemnation. “Firemen take an oath to uphold the law,” said Timothy Gallagher, Special Agent in Charge of the Newark FBI Field Office. “The FBI works to ensure that they are held accountable when they violate that pledge and break the law.” Peter Nozka, Acting Special Agent in Charge of the U.S. Department of Labor Office of Inspector General, emphasized the impact on hardworking New Jersey citizens, stating that his office will continue to aggressively investigate these schemes, particularly those impacting patients of programs administered by the Department of Labor.

The guilty plea by Michael Sher sends a stark warning: defrauding state health benefits programs will not be tolerated. While sentencing details have not yet been released, Sher faces significant prison time for his role in this multi-million dollar fraud. The investigation remains ongoing, and further charges against other co-conspirators are anticipated. Grimy Times will continue to follow this case and report on any developments.
