Michael Dontavious James, a 34-year-old felon from Marianna, Florida, has been indicted for possession of a controlled substance with intent to distribute, possession of a firearm in furtherance of a drug trafficking offense, and possession of a firearm by a convicted felon. The indictment, announced by United States Attorney John P. Heekin, is the result of a joint investigation by the Drug Enforcement Administration and the Bureau of Alcohol, Tobacco, Firearms, and Explosives, with assistance from the Florida Highway Patrol. James appeared in federal court for his arraignment and is scheduled for a jury trial on July 27, 2026.
The charges against James carry significant penalties, including up to 20 years’ imprisonment for the possession of a controlled substance count, a minimum mandatory 5 years’ imprisonment, and up to life imprisonment, consecutive to any other sentence, for the possession of a firearm in furtherance of a drug trafficking offense count. Additionally, James faces up to 15 years’ imprisonment for the possession of a firearm by a convicted felon count.
The case is part of Operation Take Back America, a nationwide initiative aimed at combating illegal immigration, cartels, and transnational criminal organizations, and protecting communities from violent crime. The prosecution is being handled by Assistant United States Attorneys Eric W. Welch and Jessica S. Etherton.
An indictment is merely an allegation by a grand jury that a defendant has committed a violation of federal criminal law and is not evidence of guilt. James is presumed innocent and entitled to a fair trial, during which it will be the government’s burden to prove guilt beyond a reasonable doubt.
