Marijuana Grow Boss Gets 10 Years in Prison
Filemon Padilla Martinez, 56, of Mexico, has been sentenced to 10 years in prison for conspiring to manufacture marijuana and depredation of federal lands. Martinez was handed down the sentence by U.S. District Judge Morrison C. England Jr. in a Sacramento courtroom.
Martinez was accused of conspiring with three co-defendants to grow marijuana in the Tomhead Mountain area of Shasta-Trinity National Forest. The operation consisted of 1,054 marijuana plants and involved Martinez recruiting, training, and supplying two of his co-defendants to tend to the site while he stayed at a nearby stash house or his residence in Ione, California.
Martinez was ordered to pay $24,778 in restitution as part of his sentence. This hefty sum is a result of the damage caused to the sensitive ecosystem of the national forest.
The investigation into this case was a collaborative effort between the U.S. Forest Service, the Tehama County Sheriff’s Department, the California Department of Fish and Wildlife, the Amador County Sheriff’s Office, and the California Department of Justice. Assistant U.S. Attorney Adrian T. Kinsella is prosecuting the case.
Two of Martinez’s co-defendants, Oscar Francisco-Diego and Francisco Gomez Sanchez, have already been sentenced for their role in the conspiracy. The third co-defendant, Timothy Charles Wilson, is currently pending trial and is presumed innocent until proven guilty beyond a reasonable doubt.
As the investigation unfolds, it is clear that the operation was a sophisticated and well-organized effort to grow and distribute marijuana on federal lands. The sentence handed down to Martinez serves as a warning to those who would seek to exploit our national forests for their own gain.
