A 42-year-old New York man was arrested at Minneapolis-St. Paul International Airport after a flight diverted due to his erratic behavior.
Mark Anthony Scerbo, 42, was charged with one count of possession of cocaine, a crime that carries a maximum sentence of three years in prison and a minimum fine of $5,000, if convicted.
According to court documents, Scerbo’s flight from New York to San Francisco diverted to MSP on May 16, 2021, after witnesses reported him walking up and down the aisle with a butter knife in his fist, snorting white powder, and possessing a bag containing a white powdery substance.
A flight attendant retrieved the bag and delivered it to police, who field-tested the substance and found it to be 24.5 grams of cocaine.
Scerbo was detained by MSP Airport Police and taken into custody.
The FBI is investigating the case, and Assistant U.S. Attorney Miranda E. Dugi is prosecuting the charge.
A criminal complaint is merely an allegation, and Scerbo is presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
Scerbo will face a federal district court judge to determine any sentence, considering the U.S. Sentencing Guidelines and other statutory factors.
