SIOUX FALLS, SD – Mark James Olson, 35, of Sioux Falls, is facing a substantial prison sentence after a federal jury found him guilty Wednesday of both illegal firearm possession and intent to distribute methamphetamine. The verdict comes after a trial revealing Olson was in possession of a loaded semi-automatic handgun and ammunition despite a prior felony conviction and current unlawful use of controlled substances.
The evidence presented in court detailed that on or around June 28, 2021, Olson was found to be holding not only the weapon but also five or more grams of actual methamphetamine, indicating a clear intent to distribute the dangerous Schedule II controlled substance. The initial indictment came down in September 2021, with a superseding indictment filed in July 2022, suggesting the investigation deepened and uncovered further incriminating evidence.
Olson now faces a maximum of 10 years in federal prison and a $250,000 fine for the firearm charge, along with a mandatory minimum of five years – potentially escalating to 40 years – and a $5,000,000 fine for the drug charge. Additionally, he’s looking at three years of supervised release following any prison term for the firearm offense, and a mandatory four years, potentially extending to life, for the drug charge. A $100 special assessment will also be levied to the Federal Crime Victims Fund for each conviction.
Federal prosecutors Jeremy R. Jehangiri and Special Assistant U.S. Attorney Beth Ebert successfully argued that Olson’s actions posed a clear and present danger to the community. The case was a collaborative effort between the Sioux Falls Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), highlighting the agencies’ commitment to tackling violent crime and illegal gun activity.
This prosecution falls under the umbrella of Project Safe Neighborhoods (PSN), a nationwide program designed to bring together all levels of law enforcement and local communities to reduce violent crime and gun violence. The Department of Justice recently reinforced PSN, emphasizing community trust-building, support for prevention organizations, strategic enforcement, and measurable results.
Following the verdict, Olson was immediately remanded to the custody of the U.S. Marshals Service to await sentencing, which is scheduled for February 6, 2023. A presentence investigation report will be prepared to provide the judge with a comprehensive background of the defendant and the circumstances surrounding the crimes. This case underscores the federal government’s ongoing crackdown on individuals who combine illegal firearms with drug trafficking, jeopardizing public safety in Sioux Falls and beyond.
