Shocking news out of Pine Ridge, South Dakota as a 27-year-old man has been charged with Second Degree Murder and Discharge of a Firearm during the Commission of a Crime of Violence. James Robert Dowty, accused in the brutal slaying of a young female on July 20, 2016, stands accused before federal courts.
Announced by United States Attorney Randolph J. Seiler, Dowty was indicted on November 16, 2016, and appeared before U.S. Magistrate Judge Daneta Wollmann on November 22, 2016, entering a plea of not guilty to the serious charges brought against him.
The maximum penalty for such heinous acts is severe: life in custody and/or a $250,000 fine, 5 years of supervised release, and a contribution of $100 to the Federal Crime Victims Fund. Restitution may also be ordered upon conviction.
According to authorities, the investigation into the tragic incident has been a collaborative effort, with the Bureau of Indian Affairs, Office of Justice Services, Oglala Sioux Tribe Department of Public Safety, and the Federal Bureau of Investigation all playing critical roles in piecing together the case. Assistant U.S. Attorney Eric Kelderman is leading the prosecution.
Dowty has been remanded to the custody of the U.S. Marshals Service while awaiting trial, where he will face the full brunt of the justice system for his alleged crimes.
Despite the charges being merely accusations at this stage, Dowty is presumed innocent until proven guilty in a court of law.
