Tracy Peters, Assault With a Dangerous Weapon, South Dakota 2016

Mobridge, SD – In a chilling case out of South Dakota, Tracy Peters, 50, has been indicted by a federal grand jury for a litany of violent crimes. The U.S. Attorney Randolph J. Seiler announced that Peters is charged with Assault With a Dangerous Weapon, Assault Resulting in Serious Bodily Injury, Assault Resulting in Substantial Injury to an Intimate Partner, and Domestic Assault by an Habitual Offender.

Peters, who was indicted on November 8, 2016, faced the charges before U.S. Magistrate Judge Mark Moreno on November 9th. He entered a not guilty plea, maintaining his innocence until proven otherwise in court.

The maximum penalty for Peters if convicted includes up to 10 years behind bars and/or a $250,000 fine. Additionally, he could face 3 years of supervised release and a contribution of $100 to the Federal Crime Victims Fund. Restitution may also be ordered by the court.

According to the Indictment, on November 3, 2016, Peters is accused of assaulting an intimate or dating partner with a dangerous weapon, which resulted in serious bodily injury. Furthermore, it is alleged that Peters has previously been convicted on at least two separate occasions for assaults against an intimate partner.

While the charges are merely accusations and Peters is presumed innocent until proven guilty, the investigation into these heinous acts is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Jay Miller is leading the prosecution of this case.

Peters was released from custody on conditions pending trial, with no trial date set as yet.
