Marlin Caceres-Guerrero, a 28-year-old native of Honduras, is facing serious charges for illegal reentry into the United States. The U.S. Attorney Kenneth A. Polite announced that CACERES-GUERRERO was charged with one count of illegal entry of a removed alien, a violation of Title 18, United States Code, Section 1326(a).
The Indictment states that CACERES-GUERRERO was previously removed from the United States on May 3, 2013. However, he was found in the Eastern District of Louisiana on February 21, 2017, without permission to reenter.
In addition to the charge of illegal reentry, if convicted, CACERES-GUERRERO could face a maximum term of imprisonment of two years, a fine of $250,000, one year of supervised release, and a $100 special assessment fee.
U.S. Attorney Polite emphasized that an Indictment is merely a charge, and the guilt of the defendant must be proven beyond a reasonable doubt. He also commended the work of the United States Immigration and Customs Enforcement agency in investigating this matter.
Assistant United States Attorney Jon Maestri will be handling the prosecution of CACERES-GUERRERO. The case serves as a stark reminder of the consequences faced by those who attempt to circumvent U.S. immigration laws.
